NextMVP provides rapid MVP development services (web apps, landing pages, feedback tools, etc.) to entrepreneurs and startups. As the website explains, NextMVP aims to "turn your idea into a ready-to-launch MVP in just weeks" (nextmvp.tech). These Terms of Service ("Terms") govern your use of NextMVP's website and services. By accessing the NextMVP website or engaging our services, you agree to comply with these Terms and all applicable laws.
In these Terms, "we," "us," or "NextMVP" refers to the company, and "you" refers to any user or client.
User Responsibilities
As a user of NextMVP's website or services, you agree to:
- Provide accurate and truthful information when submitting forms, contacting us, or creating any account. Keep contact details (email, phone, etc.) up to date.
- Comply with all applicable laws and regulations. Do not use our services or website for any illegal, infringing, or harmful activity.
- Respect intellectual property: you may not copy, reproduce, distribute, or exploit NextMVP's content (text, images, code, logos, etc.) or the content of other users without permission.
- Safeguard any account credentials. If you create an account (e.g., for the Referral Program or any member area), you are responsible for all activities under that account. Notify us immediately of any unauthorized use.
- Ensure that any idea, content, or materials you provide (including designs, text, images, code) are owned by you or that you have permission to use them.
- Use the Referral Program (if you join it) ethically and in accordance with any specific program rules. You must not use automated or dishonest methods to generate referrals.
Failure to follow these responsibilities may result in suspension or termination of your access to our services and may subject you to legal liability.
Service Availability and Limitations
NextMVP strives to deliver your MVP on schedule (typically within 2–4 weeks as noted on our site) and to provide reliable service. However, we do not guarantee uninterrupted or error-free operation. The service and website are provided "as is" and "as available." Specifically:
- No Uptime Guarantee: Although we aim for high availability, we cannot guarantee continuous operation or 100% uptime. We may need to perform maintenance or updates, which can cause temporary outages.
- Modifications: NextMVP reserves the right to modify, suspend, or discontinue any aspect of the services or website at any time without notice. We may also update these Terms from time to time.
- Third-Party Services: Our services may rely on third-party software, hosting, or APIs. We are not responsible for outages, changes, or data loss caused by any third-party.
- Performance and Results: We do not guarantee any specific business or technical outcome (such as user growth or revenue) from your MVP. We will use reasonable skill and care to build your product, but the success of the MVP in the market depends on many factors beyond our control.
You acknowledge that factors beyond NextMVP's control (internet issues, force majeure events, your own actions, etc.) can affect service quality. NextMVP is not liable for such disruptions.
Intellectual Property Rights
NextMVP Content
All materials on the NextMVP website and portfolio (including text, images, graphics, logos, and code) are the property of NextMVP or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use or reproduce these materials without our explicit written permission. Any unauthorized use may violate these laws and these Terms.
Your Content and Ideas
You retain ownership of any ideas, content, or data you submit to NextMVP (for example, the concept or specifications for your MVP). By submitting such materials, you grant NextMVP a non-exclusive license to use, reproduce, modify, and display them solely for the purpose of providing the services. We respect the confidentiality of your information – as stated on our site, "your idea is safe with us" and we "offer NDA agreements to protect your intellectual property". Those NDAs further ensure that any project-related information you share remains confidential.
Deliverables
Upon full payment, we grant you a license to use the final deliverables (designs, code, etc.) for your business. Any pre-existing tools, templates, or proprietary technology used by NextMVP in the project remain our intellectual property, subject to the license granted. You agree not to remove or alter any copyright, trademark, or other proprietary notices included in the deliverables.

Account Creation and Termination
Accounts
NextMVP's core services (MVP development) do not require you to create a public user account on the website. However, certain features (such as the Referral Program or a client portal, if available) may require registration. If you create an account, you agree to provide accurate information and to maintain the security of your password. You are responsible for all activities that occur under your account.
Termination by You
You may discontinue using NextMVP's services at any time. If you have an account, you can request that we terminate or delete it by contacting us (see "Contact Information" below).
Termination by NextMVP
NextMVP reserves the right to suspend or terminate your access to our services or the website at any time, with or without notice, for any reason including (but not limited to) violation of these Terms, non-payment, or illicit activity. In the event of termination, your right to use the services or account ends immediately. Any provisions that by their nature should survive termination (such as Intellectual Property Rights and Limitation of Liability) will remain in effect even after termination.
Limitations of Liability
To the fullest extent permitted by law, NextMVP and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the services or website. This includes, without limitation, damages for loss of profits, revenue, data, or goodwill. NextMVP's total liability for any claim related to the services will in no event exceed the total fees actually paid by you to NextMVP under that specific agreement.
NextMVP makes no warranties or guarantees, express or implied, about the services. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement. You acknowledge that the MVP development process involves inherent risks and uncertainties; NextMVP is not responsible for third-party actions (e.g., data breaches of hosting providers) or your own decisions (e.g., deployment choices).
Example: If your MVP does not achieve market success or you lose data from your own usage, NextMVP is not liable for such losses.
Governing Law and Dispute Resolution
These Terms are governed by the laws of Nigeria without regard to conflict of laws principles (choose the jurisdiction where NextMVP is located). Any disputes arising under these Terms will be resolved exclusively in the courts of that jurisdiction. You and NextMVP submit to the personal jurisdiction of those courts. By using our services, you waive any right to a jury trial for disputes related to these Terms.
You agree to attempt to resolve any disagreements through good-faith negotiation before pursuing litigation.
Changes to Terms: NextMVP may modify these Terms at any time by posting updated Terms on the website. Your continued use of the site or services after such changes will constitute acceptance of the new Terms. We encourage you to review these Terms periodically for updates.
